The Host - Terms and Conditions

Introduction

Welcome to The Host, operated by Benchmarkless OÜ ("we," "us," or "our"). By downloading, installing, or using The Host mobile application ("App"), you ("User" or "you") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please refrain from using the App.

Acceptance

By using the App, you agree to these Terms, our Privacy Policy, and any terms that apply to in-app purchases you make.

Eligibility

There are no specific requirements or restrictions for users to create an account on The Host. However, users must comply with all local laws and regulations.

Modifying the Services; Termination

We may modify the Services at any time or discontinue them altogether. You can terminate your account in the app settings. We reserve the right to terminate your account if you violate these Terms or if we deem your use of the Service to be inappropriate.

User Content

Users retain ownership of all data they input into the app, including event details and guest information.

Users can request the deletion of their data at any time by contacting support@thehostsocialdiary.com

By using the app, users grant Benchmarkless OÜ the right to store and process their data in accordance with our Privacy Policy.

Prohibited Activities

Users must comply with all local laws and regulations, as well as the content restrictions imposed by Firebase. Prohibited activities include, but are not limited to, posting offensive content and engaging in illegal activities.

Subscription and Payments

Subscription details, including pricing, duration, and features, are available on the iOS App Store page for The Host.

Payments, cancellations, and refunds are managed by the iOS App Store and are subject to its policies.

Local laws regarding subscriptions and refunds will be applied.

Safety

Benchmarkless OÜ is not responsible for the actions of its users or your interactions with them. We do not conduct background checks on users. Please exercise caution and follow safety tips when interacting with others.

Rights and License

Benchmarkless OÜ grants you the right to use the Service as authorized and permitted by these Terms.

Users grant Benchmarkless OÜ a license to use their content for the purpose of operating and improving the app.

In-App Purchases

The Host may offer services for purchase through mobile platforms such as Apple’s App Store. These purchases are governed by the terms of the platforms. Most purchases are not refundable except as required by law, and certain services only grant you a specified license.

Copyright

If you believe your work has been posted on the Service in violation of your copyright, please send a notice to our Copyright Agent following the instructions in the app's agreement.

Disclaimers

The Service is provided "as is," and Benchmarkless OÜ disclaims any liability for the quality, safety, or reliability of the Service.

Limitation of Liability

To the extent allowed by law, Benchmarkless OÜ limits its liability to you for certain types of damages for claims relating to your use of the Service, the conduct of other users, and unauthorized access or use of your content. Our aggregate liability will not exceed the fees you pay us.

Arbitration

Our Agreement contains a mandatory arbitration clause. You agree that any disputes will be settled by arbitration, and you waive your right to a trial by jury or to participate in a class action. This does not apply to users residing in the European Economic Area or the United Kingdom or elsewhere where prohibited by law.

Governing Law; Venue

These Terms are governed by the laws of the United Kingdom. Actions for disputes relating to these Terms must be brought in the courts of the United Kingdom.

Indemnity

You agree to indemnify Benchmarkless OÜ for actions arising out of your use of the Service, your content, or your violation of these Terms.

Updates and Changes

Benchmarkless OÜ reserves the right to update these Terms at any time. Users will be notified of any changes via the app.

Termination

Benchmarkless OÜ reserves the right to terminate a user’s account if they misuse the app, including but not limited to using it as cloud storage.

Miscellaneous

These Terms constitute the entire agreement between the user and Benchmarkless OÜ regarding the use of The Host app.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
